论土地承包经营权出租

摘  要

土地承包经营权出租是指土地承包经营权人将土地承包经营权出租给他人（包括单位和个人）经营，他人支付土地租金的行为。现阶段，出租作为土地承包经营权流转的重要方式，在我国普遍存在并且出现了大量的问题。而理论界对土地承包经营权能否出租，出租与转包是否为同1法律概念分歧不断，土地承包经营权出租的立法规定也较为混乱，进而使得土地承包经营权出租实践中的问题得不到有效解决。根据当前存在的问题，立法机关在以后的立法过程中，1定要强化土地承包经营权的物权性质，厘清土地承包经营权出租法律关系主体，明确出租双方权利与义务，制订详尽的出租操作规程，以到达农民承包地自愿、规范、有序、依法出租的目的。
