试论保险法上的代位求偿权
摘 要
保险代位求偿制度作为保险法当中的1项专门制度，具有自身独特的地位、特征和功能，在保险实务当中行使的也很普遍，保险代位求偿权也叫保险代位追偿权，它的`含义是指保险责任当中，保险事故是由于第3人的过错所造成的，保险人在向被保险人根据保险合同赔偿损失后，在其赔付金额的限度内要求被保险人转让其对第3人索赔的权利，随着我国经济的迅速发展，商业交往日益复杂，随之而来的是保险业的不断完善，但也存在着不少亟待解决的问题，下面就从保险代位的性质、制度价值、行使条件、行使代位求偿的限制和争议等方面进行阐述。

It used universally In insurance exercise, The insurance transfer position recompense also called to be the insurance transfer position pursuit compense, its meaning is refers to in the insurance responsibility, the accident is caused by the third person is mistake, the insurer pays indemnity for damage to the insured according to the insurance contract, between the pays amount limit it request the insured to transfer the right which sues for the third person.Along with our country is economy rapid development, the commercial contact is complex day by day, following is the insurance industry unceasing consummation, but also has the problem that urgently awaits to be solved, this article is elaboration on the nature of the insurance transfer position recompense, the legislation goal, the condition to carry out, the limitation and dispute about the insurance transfer position recompense.
