刑事二审程序的若干问题研究
摘要
刑事第2审程序作为普通救济程序是刑事诉讼的独立程序，也是整个刑事诉讼程序的重要环节。它对于查清案件事实，正确适用法律，维护司法权威，具有重要意义。由于我国现行刑事诉讼法关于第2审程序的规定过于简单、原则，相关司法解释规定也较少，有很多地方需要完善和改进。因此有必要在坚持刑事2审终审制的基础上，分析刑事2审程序制度建构的价值基础和功能，借鉴现代西方国家刑事2审制度的特点，针对我国刑事2审制度在立法和司法实践中存在的问题，提出完善的建议和措施。

Because our country present Law of Criminal Procedure about second trial procedure stipulation too simple, principle, the related judicial interpretation stipulation are also less, has very many places to need to consummate and the improvement. Therefore has the necessity in persisted criminal second trials trial in final the system in the foundation, the analysis criminal activity second trials procedures system constructs the construction the value foundation and the function, The model modern western nation criminal activity second trials systems characteristic, in view of our country criminal activity second trials systems the question which exists in the legislation and the judicial practice, puts forward the consummation proposal and the measure.
