论沈家本的法制思想
摘要
沈家本作为近代中国著名法学家、法制改革家和法律思想家，是清末法律改革的重要人物之1，他顺应社会发展的历史潮流，激流勇进，推波助澜，在近代的'法制改革中发挥了极为重要的作用。所以，被法史界誉为“法学泰斗”、“媒介中西法律文化的冰人”、“中国传统封建法制掘墓人”、“中国法制近现代化奠基人”。沈家本主持清末法律改革，会通中西，融合中西文化；重视人权，主张法律面前人人平等；1法立而天下共守，他主张3权分立；他奠定了中国近代法制的基础，基本上完成了中国古代法制向近现代法制的转型，促进了中国法律现代化进程；同时，亦是外来法律资源本土化的过程。
